Kenya has failed to charge Gichuru and Okemo over KPLC fraud saga, reason remains a puzzle

Why have Kenyan authorities failed to open criminal proceedings against former KPLC MD Samuel Gichuru and ex-Finance Minister Chris Okemo, whose bribery scheme cost taxpayers billions of shillings and hurt the development of power generating plans in the country?

Union of Kenya civil servant’s Secretary-General Tom Mboya Odege is asking the government to hand over the two to The New Jersey authorities to face charges as demanded by the court there. Jersey and Kenyan authorities had in early this year struck a deal that is likely to see Sh444 million seized from the secret offshore banks belonging to Gichuru and Chris Okemo repatriated.

Chris Okemo is reportedly hiding in Soroti in Uganda where his mother hailed from while Gichuru is in and out of the hospital in Kabete and Thogoto areas. At his pinnacle, looting KPLC Mr Gichuru accumulated so much wealth he could get any woman he wanted single or married. He proved that when he grabbed the wife of a former Permanent Secretary Richard Ndubai. When Ndubai filed for divorce the flamboyant billionaire Gichuru is rumoured to have paid him millions as compensation.

He said the funds stolen denied Kenyans good roads, affordable power, hospitals, schools, and medicine the lack of which caused death and anguish. Such elements he said should answer to crimes “against humanity” for enrichment at the expense of wananchi paying huge electricity bills and taxes yet suffered frequent “artificial” blackouts.

Former KPLC MD Samuel Gichuru once described as having the “Midas touch” is currently a man in deep trouble. Most of the billions of shillings he looted from KPLC and banked in offshore accounts abroad have been frozen. Gichuru is now old, ailing and reduced to a wheelchair, yet he is running away from arrest, not a welcome retirement for a Kenyan billionaire.

During his heydays, few would dare cross the MD’s path as some journalists in the alternative Media later found out. Samuel Gichuru has been reduced to an empty shell a pale shadow of his former self, thin ailing and confined to a wheelchair. Yet the New Jersey court is not about to let go and wants him and his “comrade in crime” ex-finance minister Chris Okemo jailed.

Both Gichuru and Okemo have been in “hiding” ever since warrants were issued in 2016, they have taken solace in President Uhuru Kenyatta’s declaration that his administration would not allow any Kenyan to be “tried and jailed” abroad.  Gichuru and Okemo are accused of laundering Ksh. 700 million which was wired to banks in Cayman offshore accounts.

The New Jersey court found Gichuru guilty of looting Kenyan taxpayers through exorbitant electricity bills and laundering millions through offshore accounts. He was further found guilty of having conspired to drain water out of one of the main dams, creating an artificial power deficiency in hydro-power and then importing diesel generators to produce electricity as Independent Power Producing Company.

He had, earlier on, formed an offshore Independent Power Producing Company to milk power consumers in Kenya. His many proxies locally registered companies were supplying goods and insurance, and security services to KPLC.
