BBI hearing kicks off at the Supreme Court

Chief Justice Martha Koome has a date with destiny as the Supreme Court which she is President begins hearing the final petition on the BBI bill. The Building Bridges Initiative (BBI) is the brainchild of President Uhuru Kenyatta and ODM leader Raila Odinga.

Political watchers have termed the BBI as a clever move by President Kenyatta and Mr Odinga to share political power, but the head of state has repeatedly denied this. President Kenyatta said BBI was designed to end the 5-year cycle of post-election violence in which the winner takes it all.

Many argue that Mr Kenyatta may have crafted the BBI to succeed himself, Russian Vladimir Putin style, with a Prime Minister and two Deputies. But the court has twice thrown out BBI terming it “unconstitutional null and void”! The judges waved aside more than one million appended signatures that would have seen the country hold a national referendum before the August poll.

The BBI was also passed by more than 40 county assemblies but the courts remained unconvinced! The biggest beneficiary was deputy president William Ruto who is battling to succeed Kenyatta against mounting odds. DP Ruto and his aides erupted into prolonged celebrations saying that there is indeed a “God in Heaven who loves Kenya”! But a furious President Kenyatta took to prime time news on TV to lambast his deputy demanding that he resign from the government instead of sabotaging it from within. But an adamant Ruto said “no way” describing BBI as an attempt to sneak back the “imperial presidency” through the backdoor praises the judges for a bold verdict.

And now it’s the turn of the CJ to play the final card on the fate of the BBI. Justice Koome is expected to walk the well-beaten path of no-nonsense chief justice David Maraga who overturned President Uhuru Kenyatta’s victory in 2017. Will CJ Koome rise to the occasion even with chances of a national referendum next to nil? DP Ruto and his UDA expect nothing less than the supreme court agreeing with lower courts. President Uhuru Kenyatta and his “preferred heir” Raila are crossing their fingers expecting a positive verdict.
